By accessing or using the Quotekit website (quotekit.com) and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Quotekit reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
Quotekit provides an automated SMS-based lead response, quoting, and appointment booking platform for service businesses. Our Service includes:
To use certain features of the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
By using Quotekit, you acknowledge and agree to the following regarding SMS (text) messaging:
End-users (leads and customers) must provide explicit consent before receiving SMS messages through Quotekit. Consent is obtained through opt-in mechanisms such as web forms, keyword responses, or other documented methods. SMS consent is not a condition of purchasing any goods or services.
Quotekit sends two types of SMS messages:
Message frequency varies. Transactional messages are sent as needed based on service interactions. Promotional messages are sent periodically and will not exceed reasonable frequency limits.
Recipients can opt out of SMS messages at any time by replying STOP to any message. Upon receiving an opt-out request, we will send a single confirmation message and cease all further messaging. You may also contact us at mike@quotekit.com to opt out.
Recipients can reply HELP to any message for assistance. Support is also available at mike@quotekit.com.
Message and data rates may apply. Standard messaging rates from your wireless carrier may apply to messages sent and received. Check with your wireless carrier for details about your text messaging plan.
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier.
Quotekit supports messaging on all major U.S. wireless carriers. Carrier participation may change without notice.
You agree not to use the Service to:
Quotekit charges $29 per booked appointment. The first 5 appointments are free. There are no monthly fees, setup costs, or long-term contracts. We reserve the right to change our pricing with reasonable notice.
All fees are non-refundable unless otherwise stated. You are responsible for all applicable taxes.
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by Quotekit and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Quotekit does not guarantee that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
To the maximum extent permitted by law, Quotekit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.
Our total liability for any claims arising under these Terms shall not exceed the total amount you paid to Quotekit in the 12 months preceding the claim.
You agree to indemnify and hold harmless Quotekit, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of your use of the Service or violation of these Terms.
Either party may terminate this agreement at any time. You may stop using the Service at any time without penalty. Quotekit reserves the right to suspend or terminate your access to the Service for any violation of these Terms or for any other reason at our sole discretion.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
